S.M. SOHAIL versus MST. SITARA KABIR-UD-DIN

Under Section 12 (2) section 12 (2), an unreasonable plea, no merit in the CPC, is a hindrance to the rights and justice of the other party so as to intend to drag the other party into unlawful litigation. The Supreme Court observed that in such a situation the threshold is higher. Appropriate time and reasonable cost for courts to take effective measures to prevent unlawful litigation and illegal litigation can only be a means of preventing litigation, in the present case, the Supreme Court. The petition has been filed to get the objection, dismissal and the applicant was deducted at a cost of Rs. 25,000 to be submitted to the court within four weeks of the date of the present order.
