The Constitution, Sections 3 and 4 of the Constitution of Pakistan (1973), Arts 12 and 185 (3) of the Unlawful Settlement Act, 2005 did not mean that the parties concerned had already established a civil suit in relation to the same property. The matter was settled before the execution of the Illegal Settlement Act, 2005. The provisions of the Illegal Settlement Act, 2005 cannot be quoted with reference to the ex post Rahim Tahir and Ahmad Jan and 2 other PLD 2007, as S. C423 declared it inappropriate. To the extent applicable to the previous application of the Unlawful Settlement Act, 2005, it was forbidden for a person to make a law that punishes frustration, particularly through Article 12 of the Constitution.
