Section 4 of the Azad Jammu and Kashmir Interim Constitution Act (VIII of 1974), the section 44 writ petition civil service appointment petitioner challenged the appointment of the defendant on the basis that he was less than matriculated for such appointment. The vice may not be designated as a lesser qualification. The rules and advertisement were the only basic claim that since he was serving on an ad hoc basis, he was entitled to be appointed / adjusted to a designated position according to the relevant rules, although the minimum qualification for the appointment of a chauffeur / vice-president was primary. However, it cannot be stated as a rule that a person with high qualifications, if he wishes to be appointed at a lower level, cannot be appointed; Out of force, the respondent, who was a matrix, had acquired merit. Position in Tests and Interviews It is alleged of me that some respondents have been shown to the respondents, without record support, that they will not make their appointment. Allegations of allegations of corruption, malicious or political influence cannot be accepted without any evidence, nor can the fact finding in the matter returned by the selection committee disturb the writ jurisdiction. Notwithstanding the fact that the Selection Committee travels beyond it, complying with relevant rules or any unlawful motion, the fitness set by the Selection Committee of the Department cannot be included in the jurisdiction of the writ.
