The delay in filing the benefit of Section 5 of the Civil Procedure Code (v. 1908), Section 115 of the Demarcation Act, 1908, was banned with a delay of nine days, where the law was initiated. Had set a term of his own. As such, under section 115, CPC, the benefit of section 5 of the Limitation Act 1908 could not be obtained unless the matter could be delayed when the delay in filing a civil review was made at the delay stage.
