XXXVII, Rr 1, 2 and 3 Leave Request to Defend Suit Case for Recovery Summary Procedure The plaintiff trust sued the defendant bank for not conducting bank checks that the pending account Was blocked. On this basis it can be maintained that the relationship between the debtor and the lenders and the existence of the loan was absent; a summary of the justification, where the summary procedure was not attracted, is a common case and court jurisdiction over the matter. Could not even be prosecuted because of the reason the trial court had given. The dismissal of the plaintiff's trust claim was neither sustainable nor, according to the order of the superior courts, the High Court sought the defensive steps taken by the defendants in presenting and granting leave. I refrain from recording any information as the trial court will decide. At its best, the High Court set aside the trial court's decision and sent the case to the trial court for decision. Appeal was allowed accordingly as a request for leave to defend the entire case
