ANWAR ALI KHAN versus D.G. FIA

Section 3, 5 and 10 Service Tribunals Act (LXX of 1973), Section 4 Constitution Pakistan, Article 212 (3) Service applicant was removed from the Front Service after serving his charge sheet and as indicated. An inquiry was conducted against them under some allegations against the department's representation. The applicant was not answered and the appeal filed by the applicant was dismissed by the service tribunal petition, all the charges against the indictment in the charge sheet were denied as well as the examination of the material witnesses of the showcase notice. Was not made, the inquiry was not made properly. Under the ruling that the competent authority could take a different approach, the Inquiry Officer failed to consider the basis of the applicant's request for a service tribunal to be changed on appeal, the Supreme Court also found Allowed, and appointed the matter to be decided by the Service Tribunal after hearing from the petitioning parties.
