The accusation against the accused was that the defendant was the custodian of a warehouse from which 5000kg of hashish was recovered and locked in a container. One of the suspects was that he was just the keeper of the warehouse and nothing was brought to the evidence to show that he knew the intoxicant was hidden in the vessel, and handed over the narcotic substance. The accused persons were not arrested on charges of trying to smuggle drug addicts into the FIR and Neither the suspect, who was the custodian of the warehouse, nor any drugs were recovered from the cavity on his identification. No investigation was made for or for attaching the suspect to drug paraphernalia.
