ABDUR REHMAN versus SYED TASADDUQ HUSSAIN
Article 15 Constitution of Pakistan (1973), Article 185 (3) Failing to prove other landlord's personal claims, the tenant's contention was that the landlord's statement on the oath did not order respect and his request Was not legalized. Personal necessity was not an extension of it because it failed to prove the remaining two grounds, namely, the payment of rent, by default, and thereby requested an exemption from it. There is no effect on the basis of personal necessity which was sufficient to maintain the eviction itself. The Supreme Court refused to interfere with the High Court-approved eviction order against the tenant.
