MESSRS MAROOF KNITWEAR (PVT.) LIMITED versus ALLIED BANK OF PAKISTAN LIMITED
The Banking Court rejected the request for leave to amend the section 10 Civil Code of Conduct (v. 1908), O VI, R 17 Constitution of Pakistan (1973), Article 185 (3). ? Also, the request raised by the lender, by the High Court, was that the modification of the applications could be sought at any stage. Legal proceedings were authorized at any stage to allow the modification of applications at its discretion, but did not oblige the court. Once the petition is transferred, the court has not arbitrarily encountered any unlawful interference or discretion, allowing the amendment to the case. The court allowed and supported the borrower to use the material available on the suit record. The original application was denied on grounds of appeal for leave to appear and to apply for defense of the suit leaf
