SHAH MUHAMMAD versus MEMBER, BOARD OF REVENUE
After the hearing of the petition filed for Section 39, 44, 161 and 164 Constitution of Pakistan (1973), Article 199 constitutional petition, the Collector was also dismissed by the Additional Commissioner. Against the order passed in the Appeal of the Additional Commissioner Member, filed before the Board of Revenue, the Board of Revenue merely instructed the collector to deal with the issue of review by directing the Board of Revenue to act. The order, which was ambiguous and the review request was not accepted by the Board of Revenue, nor was the order passed by the Collector and Additional Commissioner set aside in an unexamined order passed by the Board of Revenue. No attempt was made to satisfy the arguments presented by the Collector and Additional Commissioner. The Board of Revenue was set aside by the High Court to decide the review.
