Both suits will retain their identity, despite the durability to prosecute. The previous case will not be affected by Section 5 of the Sindh Civil Courts (Amendment) Ordinance 2002, which was later moved to the High Court because of the prosecution so that only the court's decision can be avoided in dispute. This special jurisdiction will be heard by both the High Courts
