GHULAM RABBANI versus GHANDHARA NISSAN (PVT.) LIMITED, KARACHI
The assertion of 5, 9, 13 and 16 appointments under the Sindh Assembly Secretariat (Recruitment) Rules 1974, whereby a Government servant was appointed as the Additional Secretary to the Assembly by the Speaker Assembly, was claimed. That he was not approved as governor. The rules obtained under Cls (2) and (3) of Articles 37/127 of the Constitution of Pakistan (1973) were inadequate and the appointment of a public servant as Additional Secretary to the Assembly by the Speaker Assembly was in conflict with the law. In view of the fact that the prediction of these principles itself had shown that the Assembly Rolls were made with the approval of the Governor, there was no reason to deny that the Governor's approval had been obtained.
