SANDOZ (PAKISTAN) LTD:, JAMSHORO, DISTRICT DADU versus MUHAMMAD ABDUL MALIK

West Pakistan Industrial and Commercial Employment (Standing Orders) Ordinance 1968 Section 2 (i) Worker who was employed as Warehouse Charge for his services, after almost six years of his appointment without any inquiry and for any reason. Complaint complaints filed by the employee without assignment were suspended. Against his dismissal, the employer alleged that the applicant did not come under the definition of employees as the standing orders were given in section 2 (i) of the Ordinance 1968 and his complaint was not a qualified employee. Although the charge remains as a warehouse, the employee himself can neither discharge his subsidiaries nor supervise and inspect their work in any way. The employer also acknowledged that the employee had been given junior manager's grade, but was not performing the duties as an employee who was appointed warehouse keeper. Skilled and even knowledgeable work and although he was given a junior ma grade, there was nothing in the evidence that he had been assigned any administrative duties to request leave to the higher authorities for final orders. Sending was an employee's usual job and was not a task that involved supervisory control or discretion. For this question, it is essential to consider whether the employee was an employee and not a designation. Because of the seniority, the employee is given some supervisory duties in addition to his or her original duties. Does not form part of the work that has been done. Warehouse keeper to pay for his job
