The appellant, who worked as a mobile credit officer with the Industrial Relations Ordinance 1969 Section 25A Bake Benefit Bank, was charged with some misconduct and removed from his job. Was made but the appellants were also restored without any benefit but they accepted the exemption to prevent back benefits. The Labor Court did not explicitly decide whether the dismissal was illegal but the appellant's decision was made because some of the other officers who were removed were restored and were in fact restored to compassion. Like other officers in the interest of justice and equality who were dismissed on similar charges but appellant was reinstated, he spent nearly four years in the wrong forum Labor Court pursuing his case. Was rightfully prevented from returning benefits, while the latter had been dragging his employer into the wrong forum for too long to be burdened with paying back benefits.
