Article 5, Schedule Part I, Item 9 Constitution of Pakistan, Article 199 Constitution Petition for Gold Jewelry Recovery Husband, petitioner's suit filed against his former wife for the recovery of gold jewelry which she claims Parents and others did them. Relatives, the Family Court at the time of the marriage ruled in favor of the petitioner, but the lower appellate court rejected the case on the ground that the Family Court was not qualified to entertain the case. There was no family dispute or controversy. Matters related to this but it was allegedly the result of a breach of promise by the wife or her parents to return the gold jewelry to such cause / dispute Schedule Section 5, of the West Pakistan Family Courts Act (Part First) I did not mean the item mentioned. The husband had no right to sue under Item No 9 (Part I) of the Schedule, 1964. The lower appellate court did not commit the same under Section 5 of the West Pakistan Family Courts Act, 1964. Keeping the decision and the order passed by the petition invalid, in those cases
