Section 409 Criminal Code (v. 1898), Section 561 was charged with breach of trust The termination of proceedings was the station house officer of the police station and it was alleged that he had kidnapped 4kg of hashish. During the raid, no one proceeded to say anything against the accused, except a policeman who stated in his statement under Section 161, CRPC that 10 kilograms of hashish was recovered from a rickshaw. Did not enter the departure nor retrieve any notice from the investigating officer. The witness, he raided the suspect and recovered 10 kilograms of hashish from the accused's house. The investigating officer presented a charge sheet to the concerned magistrate who directed the Anti-Corruption Authority to send the inquiry. The High Court directed the Anti-Corruption Establishment to be dismissed as responsible. And the well-performing officer was prevented from conducting a transparent investigation and any action against the accused till the final decision of the trial was reached by a trial court petition.
