Sections 38, 39 and 103 of the AA Constitution of Pakistan (1973), Arts 199 and 225 in the Constitution petition alleging the commission of illegal acts by the Returning Officer while stabilizing the results in the statement of the count in Form XIV and the counting statement Request for recount of polling votes due to conflicts found Reject the request by the Returning Officer and the Election Commission of Pakistan. The Election Commission had no jurisdiction to reject / direct the counting or scrutiny of invalid votes. The question was whether the alleged illegal action or violation. Was of a serious nature and consequently affected. The issue of election contradiction was left to the Election Commission subject to the recording of satisfaction under section 103AA of the Election Representation Act, 1976, the result of the election was informed, the Election Tribunal was already constituted.
