ABDUL GHAFOOR versus MIR MAQBOOL
O XLI, R 19 Reinstatement of appeal Appeals dismissed for non-prosecution The Supreme Court of Justice's effect was a contention of appellants that their appeal was dismissed by the lower appellate court for the absence of just one day for illegal proceedings. Deleted. The applicants' absence and refusal to deal with it was a stringent ruling that the court had to maintain a balance between the two limits, not wanting it to provide endless opportunities for the party to proceed and thereby delaying justice. Had to settle and not settle matters with any party. After being severely punished for a day's absence, the lower appellate court struck down the High Court's appeal within three months. The High Court did not consider the settlement of the appeal to be a mumble of justice and was not mentioned when the lower appellate court was going to expire for a period of three months so that the case could be given to the appellants till a certain date. Had to postpone. In order to proceed with the hearing of the case, the lower appellate court could not justify dismissing the appeal only for the absence of the parties and their lawyer and thereafter to dismiss the appeal on the same grounds. But the appeal was dismissed without considering the reasons for their appeals. Without appearing in the history in question, the High Court deemed it appropriate to grant the appellants another opportunity to proceed with the case.
