The relevant Section HA for the preliminary inquiry, but without the permission of the Department HO for a short period of time, could not be questioned. The magistrate dismissed the private complaint, saying that it was a family dispute and that the complaining party submitted to Section H Has failed to happen. Syed order was upheld in the appeal by session order for inquiry. Judicial inquiry could not be made by section HO under unnecessary order and the magistrate urged him to extend the time for inquiry in a private complaint in a hurry. Dismissed, assuming that the complainant was not prepared to appear before Section H. Legitimate inquiries should have taken place as a result of which ineffective orders were set aside and the private complaint was directed to be transferred to another magistrate for legal proceedings.
