ALLAH NAWAZ versus MST. HASINA BIBI

The suit for acquiring the plaintiff in section 42 was that he was entitled to be the nephew of the deceased, that he would be the heir of the subordinate trial court, but the appellate court had dismissed it. The plaintiff had not filed any documentary evidence regarding the deceased's title, neither a prescription table was prepared nor any other documentary evidence brought to the file that the defendant was the nephew of the deceased. The claim and contradiction in the evidence was in the record which did not fit the claimant. The suit house was in the possession of the plaintiff was obliged to prove his case but he failed to prove that in the circumstances the review was dismissed.
