KHALID RIZWAN & CO THROUGH PROPRIETOR versus PUNJAB COOPERATIVE BOARD FOR LIQUIDATION THROUGH CHAIRMAN

The petition for contempt of deferment under Section 11 of the Section 11 Limitation Act (IX of 1908), Section 5 of the Punjab Undesirable Cooperative Societies (dissolution) Act, 1993, has been adopted by the respondents of the Operating Judge that section 60 Act 5 was not enforceable because it was a special law and the delay in filing an application against the order of the Judicial Officer could not be waived. No provision of the Punjab Undesirable Cooperative Society (dissolution) Act 1993 was given to the operative judge to refuse the application. Section 5 of the Limitation Act, 1908, states that it did not automatically apply to all enforcers but its application had to be extended exclusively to the provisions of any law which the High Court refused to intervene. Delayed the request for condolences was delayed.
