PAKISTAN POST OFFICE THROUGH POST MASTER GENERAL versus PRINCIPAL DIVISIONAL PUBLIC SCHOOL AND COLLEGE, SAHIWAL
Appeal for leave to appear and defense suit to appear for recovery of money on the basis of A. XXXVII, Rr 2, 3 Limitation Act (IX of 1908), Article 159 Defense Savings Certificates and request for defense suit. The petition was filed with a delay of more than two months beyond the 10-day statutory period provided under Article 159 of the Limitation Act, 1908, without presenting any plausible explanation for such delay, the hearing and defense on the matter. The application for, limitation, was to be filed for contempt of such delay by which to explain to the defendants about the delay of each day, Lee Which they failed to do so and petition for leave was granted for defense and due to bad sanctions, the same should not be entertained without applying for damages. In the absence of any unlawful interference or material irregularity by the court following the order of the adjournment, whereby the petition for leave to appear and to defend himself in court is filed by the defendants.
