SYED SAYEED HAMID versus DISTRICT AND SESSIONS JUDGE

Respondent for Section 491 Constitution of Pakistan (1973), Article 199 Constitutional Appeal Habitat Corporation petition has filed a petition against the applicant under Section 491, CCP, alleging that the woman was illegally and illegally with the minor applicant. Is in legal custody and should be delivered to the defendant. It was ruled in favor of the defendant that the applicant's husband was not disputed because the applicant's minor may be a natural guardian, but according to Islamic law the defendant was the minor's mother as he was entitled to the custody of the minor below.
