Section 46 Civil Procedure Code (V of 1908), suing for violation of trade numbers, the plaintiff filed an application for reinstatement of the interim injunction. In his affidavit filed with the plaintiff seeking restitution, his name was not printed on the computer list issued by the High Court Bar Association, so he remained unaware of the fixing. In the relevant case hearing, counsel for the plaintiff argued that he was unaware of the determination of the case in court, and allowed the application for rehabilitation, which would have to be submitted to the High Court within 7 days. In the event of failure by the solicitor to submit to the plaintiff the costs, restoration and application will be rejected.
