MAJOR (R.) AKBAR JAN versus COLLECTOR, LAND ACQUISITION, SUI NORTHERN GAS PIPELINE (LTD.), PESHAWAR
Sections 4, 12, 18, 34 and 54 Land Acquisition Determination of compensation application Increase in compensation amount Receive interest on additional amount of compensation Application of wording of execution Request s Compensation amount Section 18, Land Acquisition Act , In 1894 the land of the appellant was acquired along with the others. The appellant's request for objection was increased by the amount of the compensation and the appellant filed his execution request and a better amount was paid to him, however his request for interest on the increased amount was prayed for. Was justified under the Land Acquisition Act. 1894, it was obliged to pay interest from the date of occupation of the land acquired till the payment was made, in addition to payment of the amount of interest, as part of the payment of interest, for the purpose of the Land Acquisition Act 1894. Should be understood. The amount of compensation payable to an individual entitled to compensation words, such as Section 18 of the Holland Acquisition Act, 1894, would have a broader meaning and should include the amount payable for compulsory acquisition. The court will have to look through the interest to see if the appellant / owner of the acquired land was compensated. Whatever was acceptable as interest under the Land Acquisition Act, provided for by law, the amount of compensation was 1894; the Executive Court, in the circumstances, justified not permitting the appellant to make a reasonable representation. Not submitted and inappropriate order isolated. The appellant was entitled to pay interest on the increased amount of compensation from the date of the occupation, even to the extent that it was paid.
