PROVINCE OF PUNJAB THROUGH EXECUTIVE ENGINEERING versus AMMICO CONSTRUCTION (PVT.) LIMITED, LAHORE
Section 14, 17 and 39 of the Limitation Act (IX of 1908), Article 158 accorded to the awarding role of court to the respondent company after completion of the construction work, certain claims were raised against the appellant authority before the designated arbitrators. The petition filed by the defendant for award of the award as a rule of the court under Sections 14 and 17 of the Arbitration Act 1940 for the recovery of the claim was accepted by the Appellant Authority's Executive Engineer. He appeared in court and said he had no objection. When the award was finally made the rule of the court in connection with the award of the court, the appellate authority had, by appeal, granted the parties a 30-day period for Article 158 of the Guaranteed Legislation Act, 1908. The submission of an award for raising an objection, if a party cannot be allowed to raise any objection after a later period, any provision of law in respect of the award invites objections by a party to a court. No specific giving date needs to be set. Within the stipulated time, the parties had a choice whether to raise an objection or not, the Appellate Authority's executive engineer appeared in the court and made a special statement that if the award court rules the appellant authority, it has no objection. The inescapable order was permanently represented until the deadline and never bothered to raise any objection to the award.
