Section 491 Habitat Corporation's petitioner's brother, allegedly Danto, had entered into some transaction to send defendants abroad and for this purpose he was paid huge sums of money to the applicant. Not sure if his brother was killed. Or that the defendants were illegally imprisoned in an unknown location. The applicant did not indicate or disclose any place from which the recovery of his brother may be obtained under section 491, CRPC can only be held in illegal and illegal custody and not for anyone. In this case, including coming to the rescue of a party, where the matter clearly falls under some other clause of the law, the petition is excluded from the premises for this purpose. \ R \ n
