The accused was arrested on a request for a section 491 habeas corpus while on the bail the accused, Ditto (accused), and the recovery of the accomplices were charged for a case under Section 37 376, PPC but they were subjected to a complaint by the court. The court had granted bail. For the guarantee of only co-accused, which was accepted, the complainant did not run any request to cancel Danto's bail but Danto was arrested by police officers, through any court, Bail was granted, therefore, detention was inappropriate Habitas Corpus' request was granted and Ditino was ordered to be released
