FEDERATION OF PAKISTAN THROUGH SECRETARY MINISTRY OF LAW, JUSTICE AND PARLIAMENTARY AFFAIRS, ISLAMAB versus DR. MUBASHIR HASSAN
Article 188 Supreme Court Rules, 1980, AXXVI, R6 National Reconciliation Ordinance (LX of 2007), by a lawyer reviewing the Federal Court of Justice's decision to review the jurisdiction of the Supreme Court. The central issue was not sustained nor was the parliament passed the ordinance as an act nor defended the law, but did not oppose the restoration of criminal cases under the said ordinance. A review petition was filed by the Federation Council on the Supreme Court decision. The applicant / federation did not state that, under the circumstances, the federation was a disturbed person or in the interest of justice, the court should disclose any other good reason for falling under the jurisdiction of the Supreme Court. Even the applicant's lawyer for review was allowed to discuss the matter so that if the court finds that a case has been made for review. Permission will be allowed to allow arguments, which could only be discussed under the Supreme Court Rules, 1980, by the lawyer who appeared for the federation in the central case, requesting review by that lawyer in the petition. A permission was allowed to discuss who did not confess. OXXVI's submission to the federation in the main case was a violation of R6 of the Supreme Court Rules 1980 and the review petition was therefore rejected by the Supreme Court.
