And in this case, pending leave to defend the application, the suit was dismissed, so the whole procedure was in accordance with Section 10 (10) (11) of the Financial Institutions (Recovery of Finance) Ordinance 2001. And therefore transfer the suit to either of the BF's. At this stage, the court will not fulfill any purpose as approved by the Banking Court then it will be open for applicants to file a fresh transfer request.
