GHULAM MUHAMMAD versus SECRETARY, MINISTRY OF RAILWAYS/ RAILWAYS BOARD, GOVERNMENT OF PAKISTAN
Section 9 Service Tribunals Act (LXX of 1973), Section 4 Selection Grade Responsibility to Pay Interest on Construction of Houses Appeal Service The Tribunal Appellant, who was employed in Grade 15, was approved Selection Grade 16 And he was retired. During his own application, the appellant was approved in advance of the construction of the house, amounting to Rs. 1,61,676 and deducting the amount of Rs. 1,14,780 from interest on pension and other benefits of the appellant. Applicant disputed the home building in advance because he was on a substantial pay scale B Section 15, so he was not responsible for paying any interest on building the house in accordance with the general terms of the loan and the DDO The advance contained in the Handbook House Building Advance was approved in favor of the Appellant on that day. Applicant Grades BS16 held the position that the advance grant for the construction of the houses was a financial matter and should be dealt with as well as the DDO's handbook number was an advance obligation of the houses to the public servants. Appellant was approved on this day when he was in BS 16 and was not relevant when he was in BS 15 when such advance was approved by him. If the appellant is taking up the position through regular development or only selection grade approval in BS 16, the pre-approval of the house building will be taken to a certain scale. Did not depend on the nature of the duties performed by the public servant, only the basic scale of pay was considered in which the employee was kept in the relevant time at the time of the approval of the appellant in advance of the construction of the house.
