Sections 3, 5 and 10 are excluded from the Service Tribunals Act (LXX of 1973), section 4 service. Appellant was fined a substantial dismissal, without any departmental investigation into the allegations of misconduct against him, appellant regularly denied his accusation. The departmental inquiry was absolutely necessary for the appellant to bring the charge to the house, but it was not done, together with a personal hearing against the appellant, sufficient to impose a substantial dismissal on the appellant's preliminary investigation. The serious allegations of fact against the appellant, only through regular investigation, could prove that he was given the opportunity to examine the witnesses and present them on his own defense, nothing had happened in the case. The retaliation proceeding was unsuccessful and the sentence of dismissal of the appellant could not be sustained. Or was. Disapproval Order was set up along with instructions to the Department, allowing the appeal to be re-served by the Appellant's dismissal date.
