MUHAMMAD SHARIF versus SETTLEMENT COMMISSIONER
Sections 10, 11 and 14 (1A) Allotment of land to landowner has been converted to agricultural land as a building site. Applicant being an informant, he has sought land allotment in question against pending urban units. The petitioner's request was rejected on this request. The High Court upheld the decision of the settlement authority as a building site under agricultural land with the constitutional jurisdiction properly under the authority of the Deputy Settlement Commissioner as the notified officer had no jurisdiction to allot land. Which gained the status of a building site. For the satisfaction of an Intimation Allotment claim granted by the Notifying Officer in accordance with the terms of 5 14 (1A) of the Migration (Land Settlement) Act, 1958, 16 197 1973 without jurisdiction Without that, it would not be possible to verify the Constitutional Petition. The High Court decided the case in respect of the orders laid by the SP. Remember that the constitutional jurisdiction of the court is at its discretion. I refuse to use my discretion
