Articles 42 and 54 of the suit and declaratory immunity suit were dismissed by the courts under the defendants' claim that they were the owners of the land that they inherited from their ancestors. And asserting that the sale was in favor of the plaintiffs and that their rights were ineffective, under the sale process, the legal claimants had long seized the suit land without interruption because of the two local commissioners. Plaintiffs' possession was established because of the information seized. By itself the law will speak in favor of ownership and even if it is under unregistered process, it will serve as a strong legitimate defense, on the question of facts and law, of the courts below. The combined results, to some extent, were not interfered with, the High Court amended.
