O XVII, R 3 The appeal against the dismissal of the nomination filed for the eviction of evidence was the question whether the appellate court allowed the appeal of the order sheet by permitting an appeal illegally and with material misconduct. As well as making it clear that the defendants, consistently and continuously, failed to present evidence even though they were cautioned and given a last and last chance for this purpose, thereby making clear misuse and misuse of court proceedings. For which the plaintiffs could not be mistaken, so this was not justified. The appellate court's decision was set aside and the trial court reinstated to allow more latitude.
