Appeal for the Section 5 Service Tribunals Act (LXX of 1973), Section 4 Appointment for Service Tribunal Appellant resigned from the post of UDC, and shortly thereafter he requested the appointment and replaced him as LDC. An offer was made which he accepted without objection. Appellant continued to serve. At the above post, LDC had never objected to the salary and allowance drawings and the LDC the seniority list because the appointment of the appellant as LDC was fresh as it was pursuing the second senior LDC. Leaving the senior post of the UDC could not be allowed to leave. He was never appointed against the post of Appellant, but was allowed to withdraw his salary and did not exercise the powers of appointing Appellant on a scale against the post of the UDC Tribunal. Could have been the job of the department after the appointed process and to consider the issue of regularity of law and other seniority officials \ r \ n \ r \ n
