Pending criminal proceedings till the decision of the appeal of the civil suit in the Supreme Court case under Sections 7 427, 5 435 and 6 436, the case was registered against the accused / defendants on the complaint of the appellant on PPC. The challan was then made before the concerned magistrate. During the trial, a request was moved by the accused / respondents until the criminal case will be postponed until the settlement of the civil suit filed by the complainant's father. The hearing of the petition was accepted and the trial was adjourned till the decision of the case was upheld by the High Court. The reviewer and the appellant complainant had filed an appeal in the court against the decision of the High Court under which the accused should be committed and the decision must be made in accordance with the law unless the nature of the matter is the same. Which may depend entirely on the decision of the civil suit. Whether a civil suit case challenging the same case has been filed in the present case, the defendant / respondent has been subpoenaed, for which a trial is underway when the trial magistrate postponed the proceedings until the decision of the civil suit. There is no basis for the trial magistrate as well as whatever the case was by the High Court. Both proceedings were independent in nature on the judgment of the civil suit, the state was conducting a criminal case against the accused / respondents and the offenses were disclosed against the respondents, if they were to be punished, Other proceedings were filed in the nature of the suit.
