Section 497 (2) Penal Code (XLV of 1860), Sections 376 and 511 of rape, attempt to commit a crime punishable by life imprisonment or a shorter term, grant of bail, further investigation, suspicious incident. Allegedly entered into the complainant's house armed with a weapon and attempted to commit an adultery with her, an FIR reading showed that the complainant did not commit the abuse. But the accused allegedly tried to commit adultery with her, therefore, there was no provision of section 6376, PPC, which would have co-accused the present case. The bail was granted on the basis that the complainant submitted the affidavit in court to the effect that the co-accused was innocent and the complainant also filed his statement in court under the impression that the co-accused was not present at the time. Incidentally, if the co-accused was not present at the time of the participant, then the whole story narrated by the complainant would have seemed somewhat suspicious AFIR, the accused had long been inciting the complainant to commit adultery, but The complainant's inactivity or anyone else spoke volumes on behalf of the complainant for bringing the police to the notice even though it was alleged that he was involved. In other cases, however, the complainant could not prove that he was ever convicted in any of the cases filed against him.
