On the basis of Section 107 of the Special Relief Act (of 1877), the Appellate Court obtained remand on the basis of section 12, suit for specific performance for the sale of immovable property, long litigation, and new defendants. That after the restoration of this case, the plaintiff did not have a case. Any testimony was presented so that the newly added defendants would face cross-examination. The plaintiff's position was that he would rely on the statements of witnesses already listed in court and therefore no remand was required, he was present in the court as well as the defendant in order to present the witnesses. Appeal Court order found no illegal item, appeal dismissed
