Section 382B Panel Code (XLV of 1860), Section 302/34 Constitution of Pakistan (1973), Article 185 (3) The court had the discretion to consider each case in its merits and it was 5 382 B, CR P.C. Was not obligated to benefit. The Supreme Court had already dismissed the petition for leave to appeal by the accused against his conviction and conviction, but earlier granted benefit under section 382B, CRPC.
