Section 382B Panel Code (XLV of 1860), Section 302/34 Constitution of Pakistan (1973), Article 185 (3) The court had the discretion to consider each case in its merits and it was 5 382 B, CR P.C. Was not obligated to benefit. The Supreme Court had already dismissed the petition for leave to appeal by the accused against his conviction and conviction, but earlier granted benefit under section 382B, CRPC. No application was brought before him in connection with the matter. Such a request by the Supreme Court can no longer be entertained and the order passed before the Supreme Court cannot be returned to the present application after such a long period. The leave of appeal was rejected by the accused and accordingly his application was dismissed.
