The IX, Rr 6 and 13 precedent, together with the order of the former party proceedings, was passed, on a date when neither the case was settled nor summoned, but only partial. Only the hearing request was made. In such history the plaintiff's previous party discharge will be void if excluded from such invalid prior proceeding, without any legal authority and separately liable.
