MESSRS ROYAL ENG. versus HABIB BANK LIMITED
O XLI, Rr 5 & 8 of the Constitution of Pakistan (1973), Act 185 (3), after collecting half the amount for bank loan collection, after filing leave and dismissing the application for defense of claim. It was decided that on appeal, the borrower of the judgment sought to halt the execution of the decree, allowing the High Court to set the execution, with the condition that half of the money deposited by the court creditors was deposited. To be made, was that the bank manager had received an unauthorized amount of money from his accounts and was subsequently dismissed on such an act as the Banking Court In his defense of the suit, he had erroneously dismissed his request for leave. If the manager is found guilty of misappropriating money, the first person to decide will not be responsible for paying the amount. The order of the High Court regarding the deposit was suspended and the execution was stopped, thereby allowing a petition.
