MAHRAM KHAN versus FATEH KHAN
Section 13 and 24 Civil Procedure Code (v. 1908), Section 11 and OXXIII, R1 Pre-Impression Suit Trial Court directs the plaintiff to submit one-third of the sale price (ZARIME) to the plaintiff to withdraw the case. Due to non-submission of third-party OEMs, fresh filing and the case were dismissed as evictions could be implemented before it could be overcome. It could be applied in accordance with section 13 of the Punjab Pre-Emission Act 1991 and the case could be dismissed. The non-submission of the sale price to Zar-e-Som had the effect of banning the removal of the new suit under section 24 of the Punjab Pre-Emission Act 1991, ultimately the decision of the parties' right is subject to appeal or revision decision.
