AMANAT KHAN versus SUB-REGISTRAR


Sections 71, 72 and 77 of the Registration Act, 1908, and the General Clause Act (X of 1897), Section 24 of a Constitution of Pakistan (1973), Article 199 of a Constitutional Petition denying the sale of a sub-registrar refusal to retain the same. It was challenged on the basis that the same was not applicable as the applicant had alternative remedies for trial and appeal under the relevant provisions of the Registration Act, 1908, all but the order of disqualification was passed by the Registrar. Although the applicant could not be sued even though he had suits and alternative remedies for appeal, it was not a definite rule. In the presence of an alternative remedy, the constitutional application was not enforceable.
