As a result, the department was promoted on the recommendation of the selection committee. The order of development by the competent authority was canceled after a period of one year but on the cancellation appeal order approved by the competent authority; the appellate authority opposed the government employees to restore the initial order of development. The order was not challenged in the appeal, which was filed seven months after the approval of the appeal of the public servant, in which it was requested to be promoted as a cook instead of a public servant. And the competent authority accepted the government employee's opposing application as an appeal and left the public servant at his original post of the presiding officer, as he was forbidden from developing a guard in grade BPS4. Because Item 26 of the Schedule states that the rules relating to the appointment of Head Barrier in Grade B5 and the appointment of Cook / Bearer in grades B4 Sections 2, 4 and 8 of the Azad Jammu and Kashmir Civil Servants Act 1976 , Provided that the vacancies are filled in the civil service of the State. Only in the prescribed way could the BPS4 fill the Cook's vacancy without meeting the requirement by amending the Development Department Rules, 1984. In this regard, no justification was given by the authorities for promotion of public servants till the vacancy of kitchen in grade B4, in the absence of any kind of supply in which the public servant
