HASSAN-UR-REHMAN versus HALEEM SHAH
Order 439 (2) and 169 of Pakistan Criminal Procedure Code (CRP), Pakistan (1973), Article 185 (3) passed the order against the accused in review without notice, the unlawful accused was earlier released under section 169. Was approved by the CRPR order. The High Court held that without prejudice to the accused's prejudice which he required under section (9) of section 9439, the PC was unlawful at the time of the hearing of the law and consequently the application for leave of appeal. Was changed and it was said that the order was set aside and that was the case. After giving the accused an appropriate hearing opportunity, the High Court remanded for hearing of the review petition
