The Pakistan Penal Code Section 302/149 Constitution of Pakistan (1973), Article 185 (3) argued that the provisions of section 302/149, PPC were not attracted. After being found innocent in the police investigation, the accused was kept in column number 2 of the challan saying that the medical evidence contradicted the ocular evidence presented by the most corroborating witnesses and that the evidence of recovery was not credible.
