MUHAMMAD WASI ALAM versus SECRETARY, MINISTRY OF COMMUNICATIONS, ISLAMABAD
Pakistan Telecommunications Corporation Act 1991 Section 9 Service Tribunals Act (LXX of 1973), Employee of Section 4 of Pakistan Telecommunications Accountant after qualifying the T&T Accounts Service Examination, Part 1 and Part II respectively in 1988 and 1989 ( B 16). The establishment of the Pakistan Telecommunication Corporation, as an Accounting Officer (B17), laid down rules for the promotion of accountants, which required it to pass the departmental examination. Under the old rules, the employees took part in the T&T Accounts Service examination. Claimed to qualify. In a similar case pending before the High Court, after the passing of more departmental exams, the Pakistan Telecommunication Corporation had taken the stand that it had passed the Department of Examination for Accounts Officers to the Pakistan Telecommunications Corporation. This decision could not be deferred. Prior to the High Court Service Tribune, Al directed the corporation to consider the case for promotion to the position of Accountant Officer in accordance with the seniority-less fitness case before the Public Promotion Committee.
