MUHAMMAD ISHAQUE MALIK versus GENERAL MANAGER, PAKISTAN RAILWAYS, RAILWAYS HEADQUARTERS OFFICE, LAHORE
Industrial Relations Ordinance 1969 Section 25A & 37 (3) Upgrade Offsetting Allowance Claim for Employees, who was paid on his retirement with BPS 15, was paid accordingly but claimed Prior to retirement he was upgraded to BPS16 and that he served for one year against a position with BPS 17, thus the employee claimed that he was BPS16. I am entitled to retire and he is also entitled to a one-year allowance as he took care of his work during that time. The witness presented by the Employer Establishment, a senior officer at BPS 17, disowned himself that he had been promoted to hold an assignment at BPS 16 before retiring for employment and when moving to another job location. If posted, he will hold a senior assignment in BPS. 17 On his salary and scale, when asked to take care of the work of an Assistant Telecommunications Engineer, who was a BPS officer, 17 witnesses were also discharged when they were asked to work again for 21 days. In a higher position, the employed employees were entitled, for any period, to the allowance for a period of one year in BPS 17 which they had just performed in the discharge of the higher duties. Will be treated, and he will eventually retire. Can serve in BPS16 and can claim post related dues, pensions, etc. with BPS16.
