Articles 10 and 11 of Pakistan (1973), Article 185 (3) vacancy allotment of land displaced persons (Land Settlement) Act, 1958 are liable to senior rival claimants to the Chief Settlement Commissioner Defendants. The constitutional application in favor of the applicant after the right-of-way allotment was made, was dismissed by the High Court against the order of the Tutoring Authority. The appeal was granted whether the Board of Revenue exercising the powers of the Chief Settlement Commissioner was allowed to cancel the allotment in favor of the applicant's motion.
